PLANET QLD | Drafting Conditions of Approval

Event Outline 

This half-day practical training programme is focused on the skills required to draft lawful conditions of approval.  

These skills are a critical part of a planner's toolbox of practical skills required to participate in the development assessment framework as conditions of approval are provided for in the Planning Act 2016, Economic Development Act 2012 and the South-East Queensland Water (Distribution and Retail Restructuring) Act 2009.  

This practical training programme covers the following topics:

  • The legal context of conditions of approval;
  • Identifying when a condition of approval is required;
  • How to draft clear and enforceable conditions of approval; and
  • What are the consequences of an unlawful condition of approval.
  

Designed For

This course is designed for planners and others involved in preparing development applications or assessing development applications. It may be especially useful to young planners and allied professionals who are required to operate within the development assessment framework and planners new to Queensland or wanting to refresh.

Learning Outcomes

At the end of this course attendees will be able to:

  • appreciate when conditions should be imposed on an approval;
  • draft lawful conditions; and
  • understand when conditions imposed on an approval are unlawful.

Michael Leong MPIA (Fellow) - Partner, Corrs Chambers Westgarth

Michael is a specialist in planning, environment and valuation litigation and advice, drafting statutory planning documents and negotiating infrastructure documents. In addition to his legal qualifications, Michael holds a Masters of Urban and Regional Planning and formerly worked as a town planner.

Michael is a fellow of the Planning Institute of Australia, a former President of the Queensland Environmental Law Association Inc and a former board member of Urban Futures Brisbane.
